Marji’in Addini Shaikh Yakubi: HARAMCIN ZUBAR DA JINI HARAMCI NE MAI TSANANI A MUSULUNCI:

Godiya ta tabbata ga Allah Ubangijin Talikai, tsira da amincin Allah su tabbata ga mafificin halittarsa Muhammad da Alayensa tsarkaka.

Mutum yana da wata daraja da kima mai girma a cikin shari’ar musulunci domin shi kalifan Allah Ta'ala ne a ban kasa; “Kuma ‘ka tuna’ a lokacin da Ubangijinka ya ce da Mala’iku: Lallai ne Ni mai sanya wani kalifa ne a ban kasa” (Bakara: 30). Don haka sai ya cancanci samun wannan karamcin daga Allah: “Kuma lallai, hakika mun karrama ‘yan’adam” (Isra’i: 70). Sannan ya bai wa ran ‘yan’adamtaka wata alfarma mai girma wacce alfarmarta har ma ta fi ta dakin Ka’aba, ya zo a hadisi madaukaki daga Abu Ja’afar Imam Bakir (as) cewa ya fuskanci Ka’aba sannan ya ce: “Godiya ta tabbata ga Allah wanda ya karramaki, ya daukakaki kuma ya girmamaki, haka nan kuma ya sanya ki makoma da aminci ga mutane, amma ina rantsuwa da Allah! Tabbas alfarmar mumini tana sama da alfarmarki”[1]. Kuma a cikin Sahihat ta Abu Hamza daga Imam Bakir ko Imam Sadik (as) daga Manzon Allah (s.a.w.a) game da wata waki’a ta kisan kai da ta faru kuma aka rasa makashin – kusan kamar dai yadda a yau yakan faru a yi kisan kai a rasa makashin – ya ce: “Matacce a tsakankanin musulmai ba a san wanda ya kashe shi ba! Ina rantsuwa da wanda ya aikoni da gaskiya da duk wadanda suke sama da kasa za su yi tarayya cikin zubar da jinin wani musulmi kuma su yarda da hakan, to da Allah ya turmuza hancinansu cikin wutar jahannama, ko kuma ya ce: fuskokinsu”[2].

A saboda haka dan’adam ya kashe dan’adam dan uwansa to wannan fita ce daga da’ar Allah Ta'ala kuma jayya ce da shi a cikin mulkinsa, domin shi Allah Ta'ala shi ne mahaliccin dan’adam kuma mamallakinsa, haka nan kuma shi kadai ne yake da ikon ya sarrafa shi yadda ya so.

Kuma Manzon Allah (s.a.w.a) ya tsaya a Mina a lokacin da ya kammala ayyukan Hajjinsa na bankwana a gaban dubunnan gomomi na musulmai domin ya isar masu da wannan sakon ya kuma cire masu kaskanta irinta jahiliyya daga zukatansu – wato jahiliyyar da ba ta aiki da hukunce-hukuncen musulunci – ta hanyar haramta masu zubar da jini da kisan gilla na wulakanci; sai ya ce: “Wace rana ce mafi kololuwar alfarma? Suka ce: Wannan ranar. Sai ya ce: “To wane wata ne mafi girma da daukaka? Sai suka ce: Wannan watan. Sai ya ce: “To wane gari ne mafi girma da daukaka? Sai suka ce: Wannan garin. Sannan sai ya ce: To ku sani lallai jinanenku da dukiyoyinku suna da gayar girma da alfarma a kanku kamar yadda wannan rana take da alfarma a cikin wannan wata da wannan gari naku har zuwa ranar da za ku hadu da shi ya tambaye ku game da ayyukanku. Ku saurara! Shin na isar? Suka ce: Eh. Sai ya ce: Ya Allah ka shaida. Ku sani wanda ya kasance akwai wata amana a hannunsa to ya sauke wannan amanar da ke kansa ga ma’abocinta, domin jini da dukiyar musulmi ba ta halasta sai dai idan da yardarsa, kuma kada ku zalunci kawukanku, kuma kada a bayana ku koma kafirai”[3].

Domin karin bayani game da wannan lamari sai aka sanya kisan mutum kwara daya rak daidai da kisan dukkanin ‘yan’adam baki dayansu; kamar yadda ya zo a Qur'ani: “Wanda ya kashe rai ba tare da ya kashe wani rai ba, ko kuma barna a ban kasa, to kamar ya kashe mutane dukkansu ne” (Ma’ida: 32).

Shi ya sanya shari’a ta tsananta ukuba a kan salwantar da rai, to duk wanda ya yi kisa yana sane da ganganci to waliyyan jini na wanda aka yi wa ta’addanci suna da hakkin yin kisasi a kan makashin, domin irin wannan ukubar tana tunkude wanda yake da tunanin ketare iyaka ya gujewa aikata wata mummunar aika-aika ga sauran jama’a, kuma tana janyo mutane su yi rayuwarsu cikin aminci da salama, ya zo a Qur'ani: “Kuma a gare ku akwai rayuwa a cikin kisasi, ya ku ma’abota hankula, tsammaninku za ku samu takawa” (Bakara: 179).

Kuma shari’a ta wajbata biyan wasu kudi masu yawa wadanda ake kira (Diyya) ga iyalan wanda aka ketare masa iyaka, idan ya zama kisan bisa kuskure ne tabbas-tabbas, ko kuma bisa kuskure din ne amma dai ya yi kama da na ganganci, ta yadda alfarmar jini ba za ta tafi a karon kawai ba koda kisan ya faru ne bisa kuskure tabbas-tabbas.

Kuma saboda mutane su gujewa aikata duk wani aiki wanda zai iya kai su ga yin kisa ko cutar da wasu jama’a koda kuwa bisa kuskure ne, haka nan ma a cikin biyan diyya akwai gusar da fushin iyalan mamaci da kuma rufe kofar daukar fansa da fadawa cikin kisan ramuwar gayya, a saboda haka ne aka kira diyya da (hankali) domin cewa ita tana hankaltarwa wato kenan tana katangewa daga fadawa cikin zubar da jini (babu gaira babu dalili) kuma tana bai wa al’umma kariya daga afkawa cikin zubar da jinainai kafin faruwar (kisan) ta hanyar nisantar hakan, sannan kuma tana karewa daga ci gaba da yaduwar zubarwar bayan faruwar na farko.

To a karkashin wannan bayani, to lallai abin da muke gani da idanunmu a yau na abin da ya shafi tozarta jini da rigingimu masu jawo kisan kai da kisan mummuke abin da ke ta maimaituwa kurum don an samu sabani a matsaya da tunani da nazariyoyi, ko kuma wani sabani dangane da wani lamari sananne, ko kuma saboda rigimar siyasa ko ta ashira ko da’ifa ko jama’a ko yanki da dai sauransu, domin kisan kai yana daga cikin mafi munin abin da aka haramta mafi tsananinsu wajen jawo fushin Allah Ta'ala kuma mafi abin da Allah Subhanahu ya fi ki.

A saboda haka ya hau kan masu hikima da hankali su himmantu iya bakin iyawarsu wajen ganin sun gyara lamurra da halayen jama’a da kare su daga aikata dukkan wani mummunan aiki. Allah shi ne wanda ake neman dacewa a wajensa.
